Society of Construction Law New Zealand Hosted by McCaw Lewis

Senior Associate Jonathan Aquilina hosted a Society of Construction Law New Zealand event at our offices on Tuesday, 20 November. The event livestreamed a presentation on the newly-formed NZ Infrastructure Commission – Te Waihanga.

The session provided an introduction to the Commission and its objective as an independent entity to help improve how NZ co-ordinates, plans and procures new infrastructure and makes the most of infrastructure we already have.

Also covered was an overview of Treasury’s Infrastructure Transaction Unit’s findings on issued associated with the use of the NZS Conditions of Contract, with a particular focus on (i) time bars (ii) caps on liability and (iii) the role of the Engineer to the Contract, and how consultants/advisors can contribute to change the existing culture of mistrust within the sector.
